Directive 2005/84/EEC On 27 December 2005, the new EU directive on phthalates 2005/84/EEC was published. The directive replaces the former decision 1999/815/EEC.
1. What were previous phthalates requirements? Decision 1999/815/EEC: Applied to all toys and childcare articles intended to be placed in the mouth by children of less than 3 years of age and made of soft PVC containing more than 0.1% by weight of one or more of the substances DEHP, DBP, BBP, DINP, DNOP, DIDP.
2. What are new phthalates requirements (2005/84/EEC)? The new directive is effective since 16 January 2007.
* In all toys and childcare articles the Phthalates
- DEHP,
- DBP or
- BBP shall not be used as substances or as constituents of preparations, at concentrations greater than 0.1% by mass of the plasticized material, in toys and childcare articles.
* In toys and childcare articles that can be mouthed by children the Phthalates
- DINP,
- DIDP and
- DNOP shall not be used as substances or as constituents of preparations, at concentrations greater than 0.1% by mass of the plasticized material, in toys and childcare articles which can be placed in the mouth by children.
The EC commission has issued a guidance document to clarify the phrase “can be placed in the mouth”.

What are the changes?
- The new directive regulates all plasticized material.
- The use of DEHP, DBP and BBP are completely banned in any toys and children care articles.
- The ban of DINP, DIDP and DNOP applies irrespectively of the age categories of the product.
